SMS Privacy Policy.

Introduction

Matrix Integration has adopted this SMS Privacy in order to comply with things like Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), as amended by the HITECH Act of 2009 (ARRA Title XIII) and Service Organizational Controls (SOC) compliance as establish by the American Institute of Certified Public Accountants (AICPA). We also recognize our responsibility to protect individually identifiable health information under the regulations implementing HIPAA, other federal and state laws protecting the confidentiality of personal information, and under general, professional ethics.

This policy governs SMS text messaging for Matrix Integration. All personnel of Matrix Integration must comply with this policy. Demonstrated competence in the requirements of this policy is an important part of the responsibilities of every member of the workforce. Officers, employees, temporary workers, and volunteers must read, understand, and comply with this policy.

Assumptions

  • Matrix Integration must comply with HIPAA and the HIPAA implementing regulations concerned with the updating of HIPAA-related documentation, in accordance with the requirements at § 164.310, § 164.316, and § 164.530(j), among others.

  • Appropriate and timely updating of HIPAA-related documentation is both a requirement under HIPAA and good business practice.

  • Appropriate and timely maintenance of HIPAA-related documentation is essential to proving our compliance with HIPAA, responding to investigations, and to effectively serving our constituents.

Policy

This policy outlines the internal guidelines for sending SMS text messages to clients to ensure compliance with FCC regulations. Employees must follow these guidelines to protect client information and adhere to company standards. Furthermore, we use this policy to help us comply with HIPAA and PCI best practices. These guidelines are supplemental to SOC Policy 001-057 Email & Texting Policy.

Guidelines

  • Purpose of SMS Messaging:

Matrix Integration may use SMS text messages to provide clients with information about services, updates, and promotional offers. It is essential to ensure that all SMS communications align with the purposes stated in the SOC Policy 001-057.

  • Client Consent (Opt-In):

Clients must opt-in before receiving SMS messages.

  • Opt-Out Process:

Clients have the right to opt out of receiving SMS messages at any time by replying "STOP" to any message they receive from Matrix Integration or by contacting service@matrixintegration.com. Upon receiving an opt-out request, Matrix Integration must cease further SMS communications and, if applicable, send a final confirmation message to confirm the opt-out.

  • Data Security:

Employees must protect client mobile phone numbers and other personal information using reasonable security measures to prevent unauthorized access, use, or disclosure. All employees must adhere to the company's data protection policies and guidelines outlined in our SOC policies.

  • Prohibition on Sharing Mobile Information:

Client mobile phone numbers must not be shared with third parties for marketing purposes without explicit client consent. Employees must ensure any sharing of such information complies with internal policies and legal requirements.

Compliance and Enforcement

All managers and supervisors are responsible for enforcing this policy. Employees who violate this policy are subject to discipline up to and including termination in accordance with Matrix Integration’ Sanction Policy.
